Proposed Change to the Intestacy Rules

If you die without making a Will, the division of your assets on death pass in accordance with the Intestacy Rules. The Law Commission has proposed changes to these rules to now include cohabiting partners.
The Rules date back to 1925 and currently do not recognise cohabiting couples as persons able to inherit from each other’s estates.
Davina Cole, a Legal Executive in our Wills and Probate Department comments “If the proposed changes are made to the current rules then this would be a step in the right direction to making it fairer for couples who aren’t married to inherit in each other’s estates, where there isn’t a Will. However, these are only proposed changes to the current rules therefore if you want your partner to inherit all or part of your estate then the solution is simple: make a Will".
